Pa. Supreme Court Rules Gov. Rendell Misused Line-Item Veto On Family Planning Funding In 2005

The Pennsylvania Supreme Court on Tuesday ruled that Gov. Ed Rendell (D) misused his line-item veto authority in 2005 to remove abortion counseling linguistic communication from a budget bill, the AP/Philadelphia Inquirer reports. The whole decision, which overturned a lower court of justice ruling, aforementioned that "language-only" vetoes are not permitted, meaning Rendell is not allowed to strike language in a budget bank bill without canceling the associated funding in the measure (Scolforo, AP/Philadelphia Inquirer, 8/20).

The language, which was sanctioned in 2005 by the state Legislature, would receive subjected whatever federal fellowship planning funding to the same restrictions as state family planning funds -- a requirement under a 1996 state law that says such money "shall not be used to promote, perform or concern for abortions, or engage in abortion counseling." Rendell at the time aforementioned restricting the use of federal Medicaid funds likely violates the state constitution of the United States and federal law (Daily Women's Health Policy Report, 8/14/06).

Former state House Speaker John Perzel (R) and Robert Jubelirer, the state Senate's ranking Republican at the time, filed the separation-of-powers lawsuit. Senate Republican attorney Steve MacNett said that the fiscal year 2005-2006 money is presumably all spent just that the ruling will influence future budget negotiations. Rendell interpreter Chuck Ardo said that the case is "building complex," adding that the administration wanted to review the ruling before making extra comments. According to the opinion by Chief Justice Ronald Castille, the Rendell administration told the court that preventing line-item vetoes of nomenclature will cause the General Assembly to "once once more 'load up' large appropriations with objectionable conditions and put the governor (to) a Hobbesian choice" (AP/Philadelphia Inquirer, 8/20).

Though some will contend around whether Wayne Shorter's primary impact on jazz has been as a composer or as a saxist, scarcely anyone will dispute his overall grandness as one of jazz's leading figures over a farsighted span of time. Though indebted to a outstanding extent to John Coltrane, with whom he practised in the mid-'50s patch noneffervescent an undergrad, Shorter eventually highly-developed his have more than compact way on tenor sax, retaining the tough note quality and volume and, in afterward years, adding an element of casimir Funk. On treble, Shorter is well-nigh some other player completely, his lovely tone lustrous like a light shaft, his sensibilities attuned more to lyrical thoughts, his choice of notes becoming more than bare as his career unfolded. Shorter's influence as a player, stemming mainly from his achievements in the 1960s and '70s, has been terrible upon the neo-bop brigade world Health Organization emerged in the early '80s, to the highest degree notably Branford Marsalis. As a composer, he is topper known for carefully conceived, complex, long-limbed, endlessly meandering tunes, many of which feature turn jazz standards yet sustain spawned few imitators.

Shorter started on the clarinet at 16 but switched to tenor saxophone earlier entering New York University in 1952. After graduating with a BME in 1956, he played with Horace Silver for a short time until he was drafted into the Army for two long time. Once out of the overhaul, he united Maynard Ferguson's ring, get together Ferguson's piano player Joe Zawinul in the process. The next year (1959), Shorter coupled Art Blakey's Jazz Messengers, where he remained until 1963, eventually becoming the band's medicine director. During the Blakey period, Shorter as well made his debut on records as a leader, newspaper clipping several albums for Chicago's Vee-Jay label. After a few prior attempts to hire him away from Blakey, Miles Davis finally convinced Shorter to join his Quintet in September 1964, thus complemental the card of a grouping whose biggest impact would leapfrog a generation into the '80s.

Staying with Miles until 1970, Shorter became at times the band's most fertile composer, contributing tunes like "E.S.P.," "Pinocchio," "Nefertiti," "Bema," "Footprints," "Fall" and the signature description of Miles, "Prince of Darkness." While performing through Miles' transition from loose post-bop acoustic idle words into electronic jazz-rock, Shorter as well took up the soprano in recent 1968, an instrument which turned proscribed to be more suited to riding higher up the new electronic timbres than the strain. As a fertile solo creative person for Blue Note during this period, Shorter expanded his pallet from gruelling boP almost into the unkeyed avant-garde, with enchanting excursions into jazz/rock dominion toward the turn of the x.

In November 1970, Shorter teamed up with old cohort Joe Zawinul and Miroslav Vitous to form Weather Report, where after a fierce start up, Shorter's playing grew mellower, pithier, more than consciously musical, and step by step more than instrumental to Zawinul's concepts. By forthwith, he was playing generally on soprano, though the strain would reappear more than toward the end of WR's race. Shorter's solo ambitions were for the most part on hold during the WR days, resulting in only 1 untypical solo record album, Native Dancer, an attractive side trip into Brazilian-American tropicalismo in tandem with Milton Nascimento. Shorter likewise revisited the yesteryear in the late '70s by touring with Freddie Hubbard and ex-Miles sidemen Herbie Hancock, Ron Carter, and Tony Williams as V.S.O.P.

Shorter finally left wing Weather Report in 1985, only quick went into a creative slouch. Still committed to electronics and fusion, his recorded compositions from this power point became more than predictable and laboured, saddled with plodding speech rhythm sections and too complicated arrangements. After threesome modus operandi Columbia albums during 1986-1988, and a tour with Santana, he lapsed into silence, ultimately rising in 1992 with Wallace Roney and the V.S.O.P. rhythm section in the "A Tribute to Miles" band. In 1994, forthwith on Verve, Shorter released High Life, a somewhat more than piquant coaction with keyboardist Rachel Z.

In concert, he has fielded an fickle series of bands, which could be incoherent one year (1995), and list and fit the next (1996). He guested on the Rolling Stones' Bridges to Babylon in 1997, and on Herbie Hancock's Gershwin's World in 1998. In 2001, he was second with Hancock for Future 2 Future and on Marcus Miller's M². Footprints Live! was released in 2002 under his possess name, followed by Alegría in 2003 and Beyond the Sound Barrier in 2005. Given his retentive track track record, Shorter's every book and appearance ar still thirstily awaited by fans in the hope that he will shiver them once again. Blue Note Records released Bluish Note's Great Sessions: Wayne Shorter in 2006.

Rodrigo Santoro - Santoro To Play Castro In Che Guevara Biopic

300 star RODRIGO SANTORO will portray Cuban President RAUL CASTRO in moviemaker STEVEN SODERBERGH's CHE GUEVARA biopic.

The 32-year-old Brazilian actor will star opposite Benicio Del Toro, who plays the legendary revolutionary in Che.

The much-anticipated movie is based on the diaries of the Argentine guerrilla Ernesto 'Che' Guevara.

Raul Castro replaced his brother Fidel as the leader of Cuba in February (08), and Santoro admits he knows his portrayal is "a delicate" one.

Santoro says, "As an actor, I have to try to incorporate the human being. I cannot do a political analysis about him."

But he's not surprised he won the supporting role in Che: "He (Castro) has slanted eyes. I think the producers saw that and thought, 'Look here, there's a great physical resemblance.'"

To prepare for the role, Santoro spent two months in Cuba last year (07), visiting places where the Castro brothers grew up, including the house where they were both born.

He says, "It was a very strong experience."

Twisted Wheel, Fibbers, York

To strike a phrase once made famous by the Gallaghers, the industry is currently "mad for" any northern reprobate world Health Organization emerges with a pocketful of tunes and a rima oris spewing street poetry. So, in the manner of Rubber Monkeys and sound-alikes the Courteeners, brigham Young Twisted Wheel found their early gigs, only a year ago, bursting with A&R men. On first gear auditory modality, theirs is an uncouth racket somewhere between the Arctics and second-wave kindling bands like the Lurkers. Only survive, there ar glimpses of something else completely - a demented skiffle mathematical group.

Light-emitting diode by Jonny Brown, a lip-curling ball of passion non a jillion miles away from the lester Willis Young Cistron Vincent, the trio have two speeds: breakneck and double-breakneck, with drummer Adam Clarke totally over his tiny drum kit as if being goaded on by the emotional state of Keith Moon. With flashes of early World Health Organization and the Fall's northern rockabilly, at times the music is twice the amphetamine of Brown's delivery, and his berserker solos seem to come from a different rock music epoch solely. Notwithstanding, they are permit down by Brown's gruff voice. Possibly hurt the effects of touring, he sounds like a market trader with a heavy cold, and, regrettably, intriguing tales of Manchester street life (drug dealers wHO shave their legs with irish potato peelers and so on) are unintelligible. The interest level flags when they digress into identikit Libertines/Oasis ladrock, only generally, the rubia tinctorum and to a greater extent uncompromising they are, the better they get.
